PUBLIC HEARINGS

The Manager of Current Planning provided an overview of the proposed zoning amendment application to rezone the property at 11511 Turtle Bay Court from RU1 – Small-Scale Multiple Housing to C9A – Tourist Commercial to facilitate the development of commercial units and a hotel. A representative of the property developer was present to answer questions. Two adjacent residents expressed their opposition to the application noting noise, parking and traffic concerns; and two other members of the community questioned whether environmental impacts to Vernon Creek and traffic flow issues had been considered.
2. Zoning Amendment Bylaw 1243, 2024 |Z0000339 | Strata Hotel / Motel Secondary Use
The Chief Administrative Officer provided an overview of the proposed zoning bylaw amendment to allow a strata hotel/motel as a permitted secondary use specifically at the Zara located at 9652 and 9654 Benchland Drive
Dominium representative shared that the intended use has not changed from the approved Lakestone Master Plan which included an 80-unit multi-family condo building located at the centre of the Benchlands designed to operate as a strata-titled resort with a front desk/concierge and based on market demand potentially a restaurant/bar and possibly a spa. He emphasized their continued transparency about the intended use for Zara as a complete self-contained destination designed as a point of pride for the community. Total parking exceeds zoning requirements as a luxury product. Concerns expressed by area residents in letters were verbally addressed. Clarification was provided that approximately 30% of owners have expressed interest in renting their units on a short-term basis.
Sixteen members of the public spoke during the public hearing sharing concerns and offering comments on the following:
- legislation has changed to provincial short-term rentals in order to address long-term accommodation needs for those living and contributing in the community;
- current community needs should be a priority over previous master plan versions that prioritize short-term visitor accommodation by those not vested in the community;
- visitors potentially arriving with boats, trailers and multiple vehicles could cause parking issues as well as traffic and safety impacts on the neighbourhood;
- suggestion that a three-year temporary use permit be used rather than a rezoning to better understand the issues over time;
- real estate developers are interested in profit without long term consideration of the area residents;
- change from a four-story condo to a six-story condo was a deviation from the master plan and a concern;
- this is a community full of families and retirees and the character of the community and quality of life will change with short-term rentals;
- people that come on a temporary basis do not share the same pride of neighbourhood as is established through the Lakestone community by caring neighbours – this is a residential community not a resort community;
- more information and honest, transparent communication is needed for Lakestone residents;
- concerned over potential for reduced neighbouring single-family property value due to short-term rentals in condo.
The Mayor announced that Mayor and Council are not permitted to discuss the applications after the close of the public hearing and that staff will be bringing forward a fulsome report for discussion at a future Council meeting.
REGULAR COUNCIL MEETING
Announcement: The Oyama branch #189 of the Royal Canadian Legion will be hosting a Remembrance Day Service on Monday, November 11th. Please be seated by 10:30am in the George Elliot Secondary School Gym. Everyone is welcome, and an ASL Interpreter will be provided. A procession to the cenotaph will follow the ceremony. There will be a Public Open House will be held at the Legion located at 15712 Oyama Rd.
Zoning Amendment Bylaw 1242, 2024 | Z0000265 | 9850 Chase Road
Following a discussion on land use rezoning, Council gave three readings to the proposed zoning amendment for 9850 Chase Rd. from RR2 to RU1 consistent with Urban Residential Future Land Use designation and requesting that prior to adoption the District would secure a road reserve covenant and associated right-of-way on the title of the subject property to allow for future road network construction.
OCP and Zoning Bylaw Amendment | OPZ00002 | 9751 & 9819 Bottom Wood Lake Road
In discussion of the proposed OCP and zoning amendment for Westpoint Apartment Housing at 9751 and 9819 Bottom Wood Lake Rd., it was noted and there is a parallel process with City of Kelowna for the portion of the development in their jurisdiction. The District initiated a provincial application for boundary adjustment so the development would then be fully in Lake Country. The proposed amendment would align with policies in Lake Country’s town centre development and this would be a site specific zone consistent with permitted uses. Other factors such as transportation network enhancements and trail amenities would be considered in future through the subdivision and building permit processes.
Council gave first and second reading to Official Community Plan Amendment (OPZ00002) Bylaw 1247, 2024 and Zoning Amendment (OPZ00002) Bylaw 1248, 2024 and directed that it be forwarded to a public hearing, specifying that prior to adoption, the District secure, via registered covenant, a monetary contribution for off-site transportation network infrastructure upgrades.
2025 - 2029 Financial Plan Preview
Chief Financial Officer Trevor James provided an overview of the 2025-2029 Financial Plan as a high level preview, noting public engagement was planned for early 2025. While growth from new construction and subdivisions helps offset some of the tax increase, strategies will be brought forward for managing increasing costs, anticipating a 5.5%-6.5% increase. The five year capital budget is based on existing long-term master plans, with no immediate impact on taxation. December 3, 2024 the draft 2025-2029 financial plan will be on the Council agenda for consideration with first reading anticipated for December 17th.
