Planning & Development Applications

Liquor Licence Referral Application|R0000379 | 3950 Irvine Road

Council endorsed an application to the Liquor and Cannabis Regulation Branch for an interior lounge area at Folktale Cider. Council heard comments from neighbouring residents and the applicant who spoke to working with neighbours and their concerns. Council supported the application noting the cidery will provide a unique social venue in the District and is a new local business in the agritourism sector.  

Agricultural Land Reserve and Zoning Amendment | ALR00192 & Z0000333 | 12820 Trewitt Road

The application for Non-Farm Use in accordance with Agricultural Land Commission (ALC) Agri-Tourism Activities in the Agricultural Land Reserve (ALR) Policy L-04, to develop seven seasonal campsites as tourist accommodations on the property and to re-zone the property from A1 - Agriculture 1 to A1TA – Agriculture 1 (Agri-Tourism Accommodation) was referred back to staff to address concerns raised by Council’s advisory committee, the Agricultural Advisory Committee (AAC). The AAC specifically requested the use result in no loss of agricultural land, ensure compliance with the zoning bylaw, spray buffers be put in place to protect the property to the north as well as on the property and also to ensure the proposed septic system results in no loss of viable agricultural land.

Development Variance Permit | DVP00398 | 10074 Highway 97

Council approved the variance request to permit the existing non-conforming signage on the building as well as allow for an additional new fascia sign (four signs in total) at the Dairy Queen business to improve their business visibility. Within the C1 – Town Centre Commercial zone, the Signage Regulation Bylaw 501, 2024 permits two signs. 

Zoning Bylaw Amendment|Z0000335|14198 Middle Bench Road

Council gave first and second readings to Zoning Amendment Bylaw 1265, 2025, which will be forwarded to a public hearing. The applicant proposes to use an existing residential building with five sleeping units for Agri-Tourism Accommodation. The proposal aligns with the District's Official Community Plan (OCP) but necessitates an amendment to the Zoning Bylaw from A1 - Agriculture 1 to A1TA – Agriculture 1 (Agri-Tourism Accommodation).

 

Departmental Reports

Development Cost Charge (DCC) Amendment Bylaw 1233, 2024

Council rescinded third reading of DCC Amendment Bylaw 1233, 2024 and read the bylaw again as amended. The bylaw was reviewed by Council on July 16, 2024, and September 10, 2024, and then sent to the Inspector of Municipalities. Based on feedback from the Inspector the proposed bylaw was amended by putting the exclusion of secondary suites from DCCs directly in the definition of secondary suites and by removing the sewer map and including a clause that clarifies developments connected to the community sewer system will be required to pay Sewer DCCs. 

The Urban Development Institute (UDI) asked Council to consider spreading the rate increases over two years. The current proposal does not include a phased approach, and the DCC rates are set with a 1% Municipal Assist Factor for all infrastructure categories. 

UBCM-CEPF for ESS Training and Equipment 2025 Intake

Council supported the Regional District of Central Okanagan (RDCO) grant application to the Union of BC Municipalities (UBCM) Community Emergency Preparedness Fund (CEPF) for Emergency Support Services (ESS) Training and Equipment. 

Subdivision and Development Servicing Amendment (Cash In-Lieu) Bylaw 1262, 2025

Staff proposed minor amendments to the Cash in Lieu section of the Subdivision and Development Servicing Bylaw to clarify requirements and processes for both staff and applicants. These amendments are made prior to a full SDDS review and rewrite. 

 

Bylaws for Adoption and Readings Following a Public Hearing

Zoning Amendment Bylaw 1243, 2024 | Z0000339 | Strata Hotel/Motel Secondary Use

Zoning Amendment (Z0000339) Bylaw 1243, 2024 to clarify secondary uses to include Strata Hotel/Motel to allow for short term rentals for Zara at Lakestone was read a first and second time on October 1, 2024 and a public hearing was held on November 5, 2024. 

The bylaw was amended by limiting the Short-Term Vacation Rentals to a maximum of up to 26 units (30%) to be used at any one time, and the requirement for a minimum stay of five nights; and was read a third time as amended. 

Zoning Bylaw Amendment | Z0000341 | Backyard Chickens

Zoning Amendment (Backyard Chickens) Bylaw 1246, 2024 was read a first and second time on October 15, 2024 and a public hearing was held earlier in the evening on January 14, 2025. Council added an amendment to the bylaw requiring an annual permit for backyard chickens and the bylaw was read a third time as amended. The bylaw will allow up to five hens to be kept on lots zoned RR3 and RU1 as long as the lots are at least 500 m2 in size. 

Fees Amendment (Business Licence) Bylaw 1244, 2024

Fees Amendment (Business Licence) Bylaw 1244, 2024 was read a first, second and third time on December 17, 2024. The amending bylaw reduces business licence fees for home-based businesses that do not receive clients or customers at home which will help small home-based businesses that have no impact to the surrounding neighbourhood (noise and traffic) be successful and able to manage the annual licensing cost.

Highways and Building Regulation Bylaw Amendments for Driveways and Driveway Accesses

Council adopted Highways Amendment Bylaw 1256, 2025 and Building Regulation Amendment Bylaw 1257, 2025 which received three readings on December 17, 2024.

Official Community Plan Amendment (OCP00061) Bylaw 1263, 2024 was read a first and second time December 17, 2024 and a public hearing was held earlier in the evening January 14, 2025. Council proceeded with reading the bylaw a third time following the Public Hearing.
